PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOPUR ORDER AND
RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE.

1 FORMATION OF THE CONTRACT

1.1
These terms of sale (“Terms”) apply to goods supplied by Bronze Orchid Ltd trading as Marc Quinn
(“Marc Quinn”) of 46 – 48 Pear Tree St, London EC1V 3SB and ordered from Marc Quinn’s website
shop at shop.marcquinn.com (the “Website Shop”)

1.2
These Terms should be read carefully by you before you place an order for goods from Marc Quinn.
You will be asked to accept these Terms before placing your order. If you do not accept these Terms
you should not place an order.

1.3
No contract exists between you and Marc Quinn for the sale of any goods until Marc Quinn has received
and accepted your order and sends you a confirmation by writing or email to the address or email that
you have given. Marc Quinn shall not be under any obligation to accept your order but once it has done
so by sending you confirmation by writing or email there is a binding legal contract between you and
Marc Quinn.

1.4
You must be sixteen (16) years of age or older to order from the Website Shop and by accepting these
Terms you are confirming to us that you are no less than sixteen years of age.

1.5
Any contract between you and Marc Quinn is subject to your right of cancellation if you are a consumer
(see 5.1 below)

Marc Quinn may change these Terms without notice to you in relation to future sales.

2. AVAILABILITY, DESCRIPTION, SPECIFICATION AND PRICE OF THE GOODS

2.1 All goods are subject to availability. If on receipt of your order the goods you have ordered are not
available in stock, Marc Quinn will inform you as soon as possible and refund or re-credit you for any
sum that has been paid by you or debited from your credit card for the goods.

2.2
The description, specification and price of the goods you order will be shown on the Website Shop at
the time that you place your order.

2.3
Subject to 2.4 below, the price of the goods will be the price quoted on the Website Shop at the date
that the order is received. All prices are quoted in UK pounds sterling and will, unless specified to the
contrary not include the price of postage and packaging, which will be added on confirmation of your
address and prior to you placing your order.

2.4
Every effort will be made to ensure that prices shown on the Website Shop are accurate at the time you
place your order. If an error is found prior to despatch of the goods, Marc Quinn will inform you as soon
as you and offer you the option of reconfirming your order at the correct price or cancelling your order. If
you cancel, Marc Quinn will refund or re-credit you for any sum that has been paid by you or debited
from your credit card for the goods.

2.5
The price of the goods on the Website Shop is inclusive of United Kingdom’s VAT rate but is exclusive of all other applicable sales taxes.

2.6
Where the goods are supplied for export from the United Kingdom, you will be liable for the complying of
any legislation or regulations governing the importation of the goods into the country of destination and
for the payment of any import duties or taxes which are levied on them.

3. PAYMENT
Payment for the goods and delivery charges can be made by any credit card that is shown as
acceptable on the Website Shop at the time you place your order. All deliveries are subject to prior
authorisation of your payment.

4.DELIVERY AND RISK

4.1
The goods that you order will be delivered to the address that you give when you place your order,
subject to confirmation of your order by Marc Quinn.

4.2
All “editions”, “unique artworks”, “bespoke books” and “jewellery” ordered from Marc Quinn shall be sent
to you via a secure courier service. Marc Quinn will endeavor to deliver unframed editions and unique
artworks, bespoke books and jewellery within the UK and EU within 14 days after receiving payment
from you and outside the EU within 21 days of receiving your payment or within such other period
indicated to you at the time of your order.

4.3
All “books”, “clothing”, “stationery” , “posters” and “tattoos” will be sent to you by Royal Mail.
Marc Quinn will endeavor to deliver the books, clothing, stationery, posters and tattoos within 7 days
after receiving your payment.

4.4
If delivery cannot be made to your address, Marc Quinn will inform you as soon as possible, and refund
or re-credit you for any sum that has been paid by you or debited from your credit card for delivery.

4.5
If there is no one at the address given who is competent to accept the delivery of the goods, you will be
notified of an alternative delivery date or a place to collect the goods.

4.6
A signature will be required on delivery of all Marc Quinn editions, unique artworks, bespoke books,
jewellery, clothing and books. Receipt of a signature at the delivery address for any editions, unique
artworks, bespoke books, jewellery, clothing and books shall be proof that the order has been delivered
to you.

4.7
Every effort will be made to deliver the goods in the time periods specified above. If Marc Quinn is
unable to deliver the goods within 30 days of receiving your order, Marc Quinn will inform you as soon
as possible and you will be entitled to cancel your order and obtain a refund or re-credit for any sum that
has been paid by you or debited from your credit cards for the goods. Marc Quinn will not be liable for
any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.

4.8
You will become the owner of the goods you ordered and responsible for risk of loss or damage to them
once they have been delivered to you.

5 YOUR RIGHT OF CANCELLATION

5.1
If you are a consumer, you have the right to cancel the contract at any time up to the end of seven
working days after you receive the goods. A working day is any day other than weekends and bank or
other public holidays in the United Kingdom.

5.2
To exercise your right of cancellation, you must have written notice to Marc Quinn by hand, post or
email, at the adress or email address shown in paragraph 9 below, giving details of the goods ordered
and (where appropriate) their delivery.

5.3
If you exercise your right of cancellation after the goods have been delivered to you, you must return the
goods to Marc Quinn at your own cost, in unused and otherwise re-saleable condition. The goods must
be returned to the address shown below by registered post. The goods must be adequately sealed in
the original packaging and you must take reasonable care to ensure the goods are not damaged whilst
in your procession or in transit.

5.4
Once you have notified Marc Quinn that you are cancelling the contract, Marc Quinn will refund or re-credit
you within 30 days of receiving notice and the once the goods are returned to the address in
paragraph 9 below.

5.5
If you do not return the goods as required after exercising your right of cancellation, Marc Quinn may
charge you for the direct costs of recovering the goods.

6 LIABILITY

6.1
Marc Quinn shall not be responsible for any defect in the goods arising from fair wear and tear, wilful
damage, accident, negligence by you or any third party.

6.2
Subject to paragraph 6.1, if the goods supplied to you are in anyway defective or you have any other
complaint about the goods, you should contact Marc Quinn by phone or notify Marc Quinn by post or
email in accordance with the contact details in paragraph 9 below.

6.3
Marc Quinn ishall not be liable for losses relating to any business (such as lost profits or consequential
loss) which arise from any failure by Marc Quinn to supply the goods in accordance with the contract.

6.4
Marc Quinn will not be held responsible for any delay or failure to comply with its obligations under
these terms of sale if the delay or failure arises from any cause which is beyond Marc Quinn’s
reasonable control. This condition does not effect your statutory rights.

7 DATA PROTECTION

7.1
Marc Quinn will take all reasonable precautions to keep the details of your order and payment secure
but unless Marc Quinn is negligent Marc Quinn will not be liable for unauthorised access to information
about you.

7.2
Marc Quinn will only use information you provide about yourself for the purpose of fulfilling your order,
unless you agrees otherwise. You can correct any information about you, or ask for information about
you to be deleted, by giving written notice at the address/email address shown below.

8 INTELLECTUAL PROPERTY

8.1
All copyright in the material contained on the Website Shop belongs to Marc Quinn or its licensors.

10 GENERAL

These terms are not intended to and shall not create any rights, entitlements, claims or benefits
enforceable by any person other than the person who is party to a contract with Marc Quinn for the
supply of goods.

These Terms and the supply of the goods by Marc Quinn will be subject to English law, and the English
courts will have jurisdiction in respect to any dispute arising from the contract.
